WAYFARE Terms of Service

You must be at least 13 years old to use WAYFARE.

If applicable law requires parental or guardian consent at a higher age, you may use the Service only after obtaining that consent.

You represent that the information you provide when creating an account is accurate and that you are legally capable of accepting these Terms.

WAYFARE is a collaborative travel-planning platform.

The Service may allow users to:

• create and organize trips;
• invite other travelers;
• manage participants;
• create and view itineraries;
• save places and destinations;
• view maps and routes;
• organize accommodations, flights, restaurants, activities and transportation;
• vote and collaborate on travel decisions;
• manage reservations;
• track budgets and expenses;
• maintain personal savings information;
• maintain packing lists;
• export trip information;
• access paid WAYFARE Plus features.

Features may be added, changed, limited, or removed as the Service evolves.

WAYFARE is a planning and collaboration tool.

Unless explicitly stated otherwise, WAYFARE is not an airline, hotel, restaurant, travel agency, tour operator, transportation provider, insurance provider, payment provider, or booking intermediary.

Information about transportation, accommodations, restaurants, attractions, travel times, routes, prices, schedules, reservations, and other travel-related information may come from users or third-party services.

You are responsible for verifying important information directly with the relevant provider before relying on it.

WAYFARE does not guarantee the availability, accuracy, safety, schedule, price, quality, or suitability of any third-party travel service.

You are responsible for maintaining the confidentiality and security of your account and credentials.

You must notify us if you believe your account has been compromised.

You may not:

• impersonate another person;
• provide false information for deceptive purposes;
• use another user's account without authorization;
• attempt to bypass authentication, authorization, Row Level Security, subscription limits, or other security mechanisms.

WAYFARE allows users to participate in collaborative trips.

Trip organizers may invite participants using supported invitation methods.

A user must accept an invitation before receiving access to private trip information, subject to the Service's authorization rules.

Information added to a collaborative trip may be visible to other authorized trip participants.

Certain information is intended to remain private, including personal savings information, personal packing information, private notes, and other individually owned resources unless explicitly shared.

You are responsible for deciding what information you contribute to a shared trip.

You may submit content such as:

• trip information;
• itinerary information;
• places and destinations;
• notes and comments;
• reservation information;
• expenses and budgets;
• images;
• documents;
• packing information;
• other content supported by the Service.

You retain ownership of your User Content.

You grant WAYFARE a limited, non-exclusive license to host, store, process, reproduce, transmit, and display User Content only as reasonably necessary to operate, secure, maintain, and improve the Service.

You represent that you have the right to submit the User Content you provide.

You may not submit content that:

• violates applicable law;
• infringes intellectual-property rights;
• unlawfully discloses another person's private information;
• contains malicious code;
• is fraudulent, abusive, or deceptive.

WAYFARE may use third-party mapping and location services, including Google Maps Platform.

Map locations, place information, route calculations, distance estimates, transit information, and travel-time estimates may be incomplete, delayed, or inaccurate.

Road closures, transit disruptions, operating hours, traffic conditions, construction, emergencies and other circumstances may affect results.

WAYFARE is not an emergency-navigation service and should not be relied upon for emergency response or safety-critical navigation.

WAYFARE may rely on third-party service providers, including providers of:

• authentication;
• database and cloud infrastructure;
• mapping and location services;
• subscription and billing infrastructure;
• app-store distribution;
• notifications;
• website hosting.

Your use of some features may also be subject to the terms and privacy practices of those providers.

WAYFARE may allow you to store or organize reservation information.

Unless explicitly stated otherwise, WAYFARE does not issue, confirm, modify, cancel, or guarantee reservations made with airlines, hotels, restaurants, transportation providers, activity providers, or other third parties.

Users must verify reservation details directly with the relevant provider.

WAYFARE may provide tools for:

• trip budgeting;
• shared expense tracking;
• personal expense tracking;
• savings tracking;
• reimbursement calculations.

These features are organizational tools.

WAYFARE does not provide banking, accounting, investment, tax, or financial-advisory services.

You are responsible for verifying amounts, currencies, splits, exchange rates and financial obligations before relying on them.

WAYFARE may offer optional paid functionality through WAYFARE Plus.

WAYFARE Plus may provide additional features, limits, exports, route functionality or other premium capabilities.

Available packages, benefits, prices and billing periods are displayed before purchase. See also the Subscription Terms.

Android subscriptions may be processed through Google Play and supported by RevenueCat.

WAYFARE does not receive or store your full payment-card details when payments are processed by the applicable app store.

Purchases may also be subject to Google Play's terms and policies.

If a WAYFARE Plus plan renews automatically, the applicable price, billing frequency and renewal conditions will be disclosed before purchase.

Unless cancelled, subscriptions may automatically renew according to the conditions presented by Google Play.

Where applicable law requires additional disclosures, notices or cancellation rights, those rights remain available to you.

You may manage or cancel subscriptions through the Google Play subscription-management tools associated with your account.

Uninstalling WAYFARE does not automatically cancel a subscription.

Cancellation generally prevents future renewal and may allow access to paid functionality until the end of the current paid period, depending on applicable store rules.

Refund eligibility is determined according to applicable Google Play policies and applicable law.

Nothing in these Terms limits consumer rights that cannot lawfully be waived.

WAYFARE may provide free and paid tiers.

Free-tier limits may include restrictions on the number of active trips or access to certain advanced capabilities.

Current limits and premium benefits will be disclosed within the Service.

We may change future free or paid feature configurations. Material changes affecting existing paid subscriptions will be handled as required by applicable law.

You may not:

• use WAYFARE for unlawful purposes;
• attempt unauthorized access;
• bypass security or subscription controls;
• interfere with the operation of the Service;
• abuse APIs or automated systems;
• use invitation functionality for spam, fraud, harassment or abuse;
• upload malicious content;
• attempt to extract server-side credentials or private user information.

We may restrict or suspend access where reasonably necessary to protect users, the Service, or comply with law.

WAYFARE's software, branding, logos, visual identity, original content, and related intellectual property are owned by Camila González / Wayfare Labs or their licensors, as applicable.

These Terms do not transfer ownership of WAYFARE intellectual property to users.

Third-party trademarks and content remain the property of their respective owners.

Use of WAYFARE is also governed by the WAYFARE Privacy Policy:

You may request deletion of your WAYFARE account through the application or through:

Account deletion may permanently remove personal information and individually owned resources associated with your account.

Shared-trip information may require different handling where it also belongs to or is necessary for other authorized participants.

Certain information may be retained where reasonably necessary or legally required for security, fraud prevention, dispute resolution, compliance, or other permitted purposes.

Deleting your WAYFARE account does not automatically cancel an active Google Play subscription.

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability.

WAYFARE may become temporarily unavailable because of maintenance, network failures, third-party providers, technical issues, or circumstances outside our reasonable control.

Travel involves circumstances outside WAYFARE's control.

You are responsible for verifying matters including:

• travel documents;
• visa and immigration requirements;
• transportation schedules;
• reservations;
• destination entry requirements;
• health requirements;
• safety conditions;
• weather;
• local laws;
• prices and availability.

WAYFARE does not provide legal, immigration, medical, financial, tax, or travel-safety advice.

To the maximum extent permitted by applicable law, WAYFARE will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

Nothing in these Terms excludes or limits liability where applicable law prohibits such exclusion or limitation.

Mandatory consumer-protection rights remain unaffected.

WAYFARE may modify, improve, restrict, suspend, or discontinue features as the product evolves.

Where legally required, users will receive appropriate notice of material changes affecting paid services or their legal rights.

These Terms may be updated from time to time.

For material changes, WAYFARE may require users to review and accept an updated version before continuing to use the Service.

These Terms are generally governed by the laws of Mexico.

Nothing in this section removes mandatory protections that may apply to consumers under the laws of their place of residence.
